On Friday, April 13th Judge Hillman determined she wants to hear argument on the associations motions to strike the declarations of Tom Anderson and David Ragland before proceeding to hear and determine the substance of the motions for summary judgment. In other words, her rulings on the motion to strike will necessarily impact and determine what evidence she will and will not consider in the context of the summary judgment motions and she wants that to proceed first. She also wants to allow the opposing parties sufficient time to respond on those issues, as well as allow us to reply to their arguments. Judge Hillman has set a hearing for Thursday, May 3 at 2p.m. solely on the motions to strike. After she rules on those evidentiary issues, she will set a hearing on the substantive motions for summary judgment.
