Association counsel filed two documents in Jefferson County Circuit Court today. A letter of explanation to Judge Hillman and Plaintiff’s Supplemental Memorandum in Oppositions Motions for Summary Judgment. The Plaintiff’s position is Defendants’ challenge to the Heising land patent is barred by the applicable statue of limitations ORS 12.040(2), the court lacks authority to grant summary judgment for Defendants on Plaintiff’s first and fourth claims for relief where Defendants failed to plead their RS2477 defense, and Defendants cannot obtain relief as to Plaintiff’s estoppel claim because the claim is asserted against the County only.
A Status Update Hearing is Scheduled for this Friday, December 7th at 9:00 a.m. in Courtroom B. The membership is not encouraged to attend. The Association will continue to work on a settlement with the Allen Trust in the hopes of reaching a working Agreement
