REPORT TO THE MEMBERSHIP – EH SPARKS TRIAL DECISION UPDATE

On September 17th, 2020, Association counsel received and email from county counsel that the DeMonte Family Trust had filed a Road Maintenance Request with Jefferson County Public Works Department on September 9th.
On September 18th, 2020 Association counsel sent a letter to the Jefferson County Commissioners and Public Works Director condemning and requesting denial of the application. That same day, Ed Trompke, counsel for the Allen Trust (Anderson parcel), Fuchs and Brant’s notified counsel for the DeMonte Trust that entry into land owned by his client would be considered trespassing and would seek legal action. Association concurred with Mr. Trompke’s notice and responded as well.On September 25th Association counsel was informed that the court ruled in over favor on our September 1st Objection to Defendant Jefferson Counties Statement of Cost and Disbursements awarding a little over $300.
On October 1st counsel for the Allen Trust, Fuchs and Brant’s worked with Association counsel in preparing the Road Vacation Petition to be filed Jefferson County. On Friday, October 2nd the Petition was filed. This Petition requested that the alleged EH Sparks road be vacated on the Allen Trust, Fuchs and Brant’s properties. On Friday, October 16th the Association filed a 2nd Petition requesting vacation of the alleged road on the Three Rivers common area known as SW Lakeview Drive from the intersection at the memorial wall to its termination at Lake Billy Chinook.
Since September 1st, Associations counsel continues to work with appellate court on finalizing the court transcripts as well as resolving the appellate settlement conference program issue.
