REPORT TO THE MEMBERSHIP – EH SPARKS TRIAL DECISION UPDATE

On Wednesday, July 22nd at 3:30 p.m. a Motion Hearing was held via Webinar with Judge Hillman in Jefferson County Circuit Court to rule on Plaintiffs and Defendants Rule 62B Motion and responses.
Those that attended were surprised that the court went beyond what was scheduled which was to grant plaintiff’s request for a time extension. We know defendants did not file their own Rule 62 request. Under the rule, defendants have 10-days to file a response from our filing date. Since the court did not grant or deny plaintiff’s request for a time extension, defendants had a plausible argument that they should have 10-days from the court’s grant of a time extension. Thus, the court extended their time but only for 10-days.
Defendants DeMonte and Jefferson County both filed their responses with the court on August 3rd. A hearing will be held via webinar on Monday, August 17th ,2020 starting at 2:30 p.m. in Jefferson County Circuit Court. The Judge has stated that she will give her decision then regarding the Rule 62B Motion.
