      EH SPARKS STATUS REPORT
      Reported October 24ᵗʰ, 2021, to the Membership.

      On September 7ᵗʰ, 2021, the DeMonte Family Trust filed a Declaratory Relief Action against LCDC and
      Jefferson County in Jefferson County Circuit Court. By process, counsel for LCDC has 30-days to
      file a response or ask for an extension. Both the purchaser and DeMonte Family Trust extended
      their negotiations until October 30ᵗʰ, 2021, in the hope of reaching an agreement on purchase of
      the property.

      On September 20ᵗʰ, 2021, the DeMonte Family Trust confirmed that the Complaint had been served on
      all party Defendants. The defendants had to mid- October to appear regarding Action. On September
      30ᵗʰ, the Appellate Court Mediator and all parties agreed to extend the abeyance through December
      31, 2021, to allow time for the declaratory Relief Action to proceed. The Mediator also informed
      all parties that every 30-days the parties need to check-in to confirm whether progress is being
      made on a settlement. If, at any time during the abeyance, it appears that settlement is out of
      reach or will take an unreasonable amount of time to achieve, the Mediator will determine whether
      reactivation of the appeal is appropriate prior to December 31ˢᵗ, 2021.

      LCDC is represented by the State of Oregon Attorney Generals office. Their counsel has requested a
      10-day notice before Plaintiff applies for a default order from Jefferson County Circuit Court. On
      October 19ᵗʰ the Plaintiff provided notice. It is believed the State will ask for more time to
      respond to the complaint. The next deadline is October 29ᵗʰ, 2021.

      5 months since the last post….. Did we miss something? we just paid more money , we should know what is going on.. at least monthly.
