      EH SPARKS STATUS REPORT
      Reported August 22nd, 2021, to the Membership.

      On July 15th, 2021, the mediator extended the abatement period to August 16th, 2021. When the abeyance period ends or 49 days from the date the case is reactivated, and the opening brief will be due.

      On August 16th, 2021, Association counsel requested the mediator to extend the abeyance period another 15-days to receive instructions from the Association Board regarding this matter. The mediator extended the abeyance period until September 30th, 2021.

      On August 21st, the Board of Directors held a Special Meeting and Executive Session to discuss the LCDC-DeMonte Family Trust, EH Sparks mediation abeyance and appellate briefing matters. The Board took the following actions.

      1. Move to direct Association counsel to send a letter to all parties advising them that there will be no further appellate mediation beyond September 30th, 2021.

      2. Move for Association counsel to proceed with appellate open brief procedure.

      Association counsel will provide an update to the Board of Directors with responses from the parties involved. The Association is hopeful that the LCDC-DeMonte Family Trust or Jefferson County will take the appropriate actions to resolve the EH Sparks matter promptly.
