EH SPARKS STATUS REPORT AND 2021 FORECAST
Reported December 20th, 2020 to the Membership and
submitted by the President and Association CounselEarlier this month a purchase offer was submitted to the DeMonte Family Trust. Negotiations have continued between DeMonte and the purchaser. The Board is hopeful a final agreement can be reached in January. A sale could lead to resolving the alleged road matter, vacation petitions, and set the groundwork for completing the platting and recording of the Associations Boundaries in 2021.
If not, the Association has learned that the Petitions for Vacation have finally reached the Commissioners. On December 16th, 2020 during a Special Meeting we believe both Petitions were discussed. On Friday, December 18th the Board learned that the Board (Commissioners) are expected to adopt its initial order (regarding the Petitions) next week. They will order the county official (Roads Master) to prepare his report. By statute, a hearing would not be set until the report is received by the Commissioners. We believe a hearing will be scheduled in early 2021.
Regarding the appeal, the process continues for thirty-days through at least January 31, 2021. Counsel has 49-days to write the opening brief once the appeal is removed from the appellate mediation program by a rejection by either Demonte or the purchaser. Counsel reviews the Trial transcript in preparation to write the appellate brief.
The Board understanding the current standings feels the Association needs to instruct counsel to write the appellate brief.
