      EH SPARKS STATUS SPECIAL REPORT TO THE MEMBERSHIP

      The long and winding road nears its end. On Wednesday, April 25th, 2022, The Jefferson County Commissioners signed the order to begin the vacation process of the Alleged EH Sparks aka CR-577 Road in Three Rivers. As anticipated, 30-days later the Commissioners through an administrative order vacated its existence on May 25th, 2022. Is the Association completely done? Not quite.

      On June 7th, County Counsel confirmed and provide the Association with a copy of the recorded vacation. The legal challenge to a road vacation order is by writ of review under ORS Chapter 34. A person challenging the order has a 60-day jurisdictional deadline from the decision allowing the vacation. ORS 34.030. What actions has the Association Taken?

      Association counsel requested and received a Motion FOR EXTENSION OF TIME with the State of Oregon Court of Appeals. The extension delays the submittal requirement for the Plaintiff’s opening brief until September 6th, 2022. Once the deadline passes (60-days from May 25th), the appeal will be dismissed.

      With the completion of this timeline the matter should be settled before the end of July or early August.
